Terms of Service
These Terms of Service ("Terms") govern your access to and use of clickclick, including the clickclick for macOS application, the companion app for iMessage, the accounts and support websites, downloads, updates, command routing, and related services (collectively, the "Service"). The Service is operated by Analog Research & Design LLC, a California limited liability company ("Analog," "we," "us," or "our").
By downloading, installing, accessing, or using the Service, you agree to these Terms, our Privacy Policy, and our Usage Policy. If you use the Service for an organization, you represent that you have authority to bind that organization.
1. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into these Terms. You are responsible for the accuracy of account information, for activity under your account, and for keeping your credentials, API keys, app passwords, command PINs, and device access secure.
If you access OpenAI, Anthropic, Google, Apple, Stripe, Supabase, or another third-party service through clickclick, you are responsible for complying with that provider's account, billing, data, usage, and acceptable-use requirements.
2. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Service on Apple-branded products that you own or control, and as permitted by Apple's Usage Rules for any App Store-distributed component.
You may not sell, lease, sublicense, redistribute, modify, reverse engineer, decompile, or attempt to extract source code from the Service except where applicable law expressly prohibits that restriction. Open-source components remain governed by their own licenses.
3. App Store and Apple Terms
For any Licensed Application distributed through the Apple App Store:
- These Terms are between you and Analog, not Apple.
- Analog, not Apple, is responsible for the Service and its content.
- Apple has no obligation to provide maintenance or support for the Service.
- Apple may refund the purchase price for an App Store Licensed Application if it fails to conform to an applicable warranty, but Apple has no other warranty obligation to the maximum extent permitted by law.
- Analog, not Apple, is responsible for product claims, privacy claims, consumer-protection claims, and intellectual-property claims related to the Service.
- You represent that you are not located in an embargoed country or on a U.S. restricted-party list.
- Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it.
These provisions are intended to align with Apple's Licensed Application End User License Agreement, Apple Media Services Terms and Conditions, iCloud Terms, Apple Privacy Policy, and App Store Review Guidelines.
4. What the Service Does
clickclick is an agentic computer-use and coding tool. Depending on your settings and permissions, it may:
- Send prompts, conversation context, files, screenshots, images, tool results, and related metadata to an OpenAI-compatible API endpoint you configure.
- Launch and control third-party AI command-line tools such as Anthropic Claude Code, OpenAI Codex, and Google Gemini under accounts you authenticate.
- Read, write, edit, delete, move, or search files in workspaces you select.
- Run shell commands, terminal sessions, browser actions, GUI actions, and other automation on your device.
- Index local project files for local retrieval-augmented search.
- Store local chat history, attachments, command logs, terminal logs, model payloads, and memory records.
- Access Apple Contacts, Messages, iMessage, Apple Notes, Apple Events, Accessibility, Full Disk Access, iCloud, and CloudKit only where you grant or configure those permissions.
- Use the companion app for iMessage to route commands and results through records in your private CloudKit database.
You are responsible for reviewing the context you provide, supervising automation, approving sensitive actions where prompted, keeping backups, and independently verifying outputs before relying on them.
5. AI Outputs and Agentic Actions
AI systems and automated agents can be inaccurate, incomplete, unsafe, duplicative, delayed, or unexpected. Outputs may not be unique and may not reflect our views or any provider's views. Actions may not operate as intended.
You must not rely on outputs or agentic actions as a sole source of truth or as a substitute for professional advice. You must use appropriate human review before using outputs in legal, medical, financial, employment, housing, education, insurance, safety, security, or other high-impact contexts.
6. Your Content
"Inputs" means prompts, files, images, screenshots, messages, credentials you choose to provide, commands, configuration, and other content you submit or make available to the Service. "Outputs" means text, code, files, images, actions, messages, and other results generated or performed through the Service.
As between you and Analog, you retain your rights in Inputs and own Outputs to the extent permitted by applicable law and provider terms. You grant us a limited license to process Inputs and Outputs as needed to provide, secure, troubleshoot, support, bill, and improve the Service.
You represent that you have all rights, permissions, notices, and consents needed to provide Inputs and direct the Service to process them, including content from files, repositories, messages, contacts, notes, screenshots, browser pages, and third-party services.
7. Third-Party Services and Provider Terms
The Service can interoperate with services that we do not control. Your use of those services is subject to their terms, privacy policies, usage policies, documentation, rate limits, and data controls. The provider terms control your relationship with that provider.
Current provider materials reviewed for these Terms include:
- Apple: Privacy Policy, iCloud Terms, Apple Media Services Terms and Conditions, Licensed Application EULA, and App Store Review Guidelines.
- OpenAI: Terms of Use, Services Agreement, Service Terms, Usage Policies, Privacy Policy, and API documentation.
- Anthropic PBC: Consumer Terms, Commercial Terms, Privacy Policy, and Usage Policy.
- Google: Google Terms of Service, Google Privacy Policy, Gemini API Additional Terms, Google Cloud Terms, and Generative AI Prohibited Use Policy.
We are not responsible for third-party services, third-party outputs, provider outages, provider model behavior, provider billing, provider account enforcement, or data processed directly by providers under your accounts.
8. Acceptable Use
You must comply with our Usage Policy. You may not use the Service to violate law, infringe rights, invade privacy, compromise systems, distribute malware, spam or harass people, deceive recipients, bypass safety controls, make prohibited high-impact decisions, exploit minors, or use provider services in ways their policies prohibit.
You must not use the Service or its outputs to develop or train a competing model, automation system, or service where prohibited by provider terms or applicable law.
9. Privacy
Our Privacy Policy explains how we collect, use, disclose, store, retain, and delete information. We do not sell personal information. We may process account, billing, usage, telemetry, support, local app, device, CloudKit, and provider-routed data as described in that policy.
10. Fees, Billing, and Credits
Paid features, subscriptions, usage credits, and one-time purchases may be handled through Stripe, Apple, or another payment provider. You authorize charges for purchases you make. Provider terms may govern cancellation, renewals, refunds, payment methods, taxes, chargebacks, and billing disputes.
Usage-based features may be metered by tokens, requests, model, operation type, or other measurements. We may correct obvious billing, credit, or metering errors.
11. Updates and Changes
We may update, modify, suspend, or discontinue any part of the Service. Some features may be alpha, beta, preview, experimental, or dependent on third-party services. Such features may change, fail, lose data, or be withdrawn without notice.
We may update these Terms by posting a revised version with a new effective date. Continued use after the effective date means you accept the revised Terms.
12. Security and Backups
The Service can affect files, applications, messages, terminal sessions, browsers, and system interfaces on your device. You are responsible for device security, permission grants, backups, repository hygiene, secrets management, and reviewing destructive or externally visible actions before they run.
Do not provide credentials, secrets, personal data, confidential information, or regulated data unless you have authority and have evaluated the risks of local processing, logging, provider processing, and third-party integrations.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express, implied, statutory, or otherwise, including warranties of accuracy, availability, reliability, security, privacy, non-infringement, merchantability, fitness for a particular purpose, and uninterrupted or error-free operation.
We do not warrant that outputs are accurate, that actions will be error-free, that data will not be lost, that third-party services will remain available, or that the Service will meet your needs.
14. Limitation of Liability
To the maximum extent permitted by law, Analog and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, business interruption, security incidents caused by your configurations, provider failures, or automation results.
Our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim or (b) USD $100.
15. Indemnification
You agree to defend, indemnify, and hold harmless Analog and its affiliates, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your Inputs, Outputs, configurations, provider accounts, use or misuse of the Service, violation of these Terms or the Usage Policy, violation of law, infringement or misappropriation of rights, or agentic actions you request or approve.
16. Termination
You may stop using the Service at any time. We may suspend or terminate access if we believe you violated these Terms, violated provider policies, created legal or safety risk, failed to pay fees, or used the Service abusively.
Upon termination, your license ends and you must stop using the Service. Sections that by their nature should survive will survive, including ownership, provider terms, disclaimers, limitations of liability, indemnification, and dispute provisions.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to any non-waivable rights you may have, disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California.
